Terms of Service

These terms apply to simbotech.com, Simbo Speak and our other products, apps and services (the "Services"), provided by Simbo Technologies ("Simbo", "we", "us"). By creating an account, installing our apps or using the Services, you agree to these terms and our Privacy Policy, Acceptable Use Policy and Cancellation & Refund Policy. If you use the Services for an organization, you agree on its behalf and confirm you're allowed to.

1. Your account

You must be at least 13 years old (16 in the EEA and UK) and able to form a binding contract. Give us accurate information, keep your password private, and tell us right away if you think someone else used your account. You're responsible for activity on your account. One person per account; don't share sign-ins.

2. Plans, payment and renewal

• Free plans include the features and monthly allowances shown on our pricing page. Allowances reset on the 1st of each month and don't roll over.
• Paid plans renew automatically each month or year at the then-current price until you cancel. We charge the payment method on file at the start of each period, through Stripe. Taxes may be added.
• You can cancel anytime in your account under Plans & billing. Cancellation takes effect at the end of the current period, and you keep paid features until then. Refunds are covered by our Cancellation & Refund Policy.
• We'll give you at least 30 days' notice before a price increase affects your subscription, so you can cancel first.
• If a payment fails, we may move you to the free plan until it's resolved.

3. Student plans, promo codes and gifts

• Student plans are for people currently enrolled at an accredited school who use a school email address. We may ask you to re-confirm it, usually once a year. The plan ends if you change to a non-school email or can't confirm it.
• Promo codes have the terms shown when issued. They have no cash value, can't be resold, and may be single-use. We may cancel codes obtained fraudulently or in breach of these terms.
• Free time from a code, a student plan or our team ends on the date shown in your account.

4. Your content and AI output

You own what you write and what the Services produce for you. You give us only the permission we need to process your content to provide the Services, as described in our Privacy Policy. We don't use your content to train AI models.

AI suggestions can be wrong, incomplete or unsuitable. Review them before you send or rely on them. You're responsible for what you send, and for having the right to use the content you give us. Don't rely on the Services for legal, medical, financial or other professional advice.

5. Your own AI keys

If you connect an account from Anthropic, OpenAI or xAI, your use of that provider is governed by your agreement with them, and they bill you directly. Simbo isn't responsible for their services, availability or charges.

6. Acceptable use

Use the Services lawfully and as described in our Acceptable Use Policy. In short: no illegal content, harassment, fraud, spam, malware, attempts to break or overload our systems, scraping, reselling, or getting around plan limits or security. We may suspend or close accounts that break these rules.

7. Our software

While you have an account, we give you a personal, revocable, non-exclusive, non-transferable license to install and use our apps and extensions on devices you own or control, under our Software License. Our apps update automatically to keep you secure. Simbo, Simbo Speak and our German Shepherd logo are our trademarks; don't use them without permission.

8. Feedback

If you send us ideas or feedback, we may use them without any obligation to you.

9. Copyright complaints

We respect intellectual property. If you believe content on our Services infringes your copyright, send a notice with the details required by the Digital Millennium Copyright Act to legal@simbotech.com. We may remove content and close the accounts of repeat infringers.

10. Changes, suspension and ending

We're always improving the Services and may add, change or remove features. If we make material changes to these terms, we'll notify account holders at least 30 days before they take effect, unless a change is required by law. You can stop using the Services and delete your account anytime. We may suspend or end your access if you break these terms or if we must by law; if we end a paid service for reasons other than your breach, we'll refund the unused part of your prepaid period.

11. Disclaimers

The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We don't promise the Services will be uninterrupted, error-free or that suggestions will be accurate.

12. Limitation of liability

To the fullest extent the law allows, Simbo won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. Some places don't allow these limits, so they may not apply to you.

13. Indemnity

If you use the Services for business, you'll defend and compensate Simbo for claims arising from your content or your breach of these terms, to the extent the law allows.

14. Governing law and disputes

These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally within 30 days. Any court case must be brought in the state or federal courts located in Texas, and both of us consent to their jurisdiction. Nothing here limits rights you have under the consumer protection laws of where you live.

15. General

If part of these terms can't be enforced, the rest still applies. Our not enforcing a term isn't a waiver. You can't transfer these terms without our consent; we may transfer them as part of a merger or sale. These terms, with the policies linked above, are the whole agreement between us about the Services. Where translations exist, the English version controls.
